All orders placed on the websites https://www.retrotapeclothing.com are subject to these General Terms and Conditions of Sale. RETROTAPE reserves the right to adapt or modify these terms and conditions at any time, the version of the General Terms and Conditions of Sale applicable to any transaction being the one appearing online on the Site at the time of the order.

02. Clients
The Customer declares to be a natural person, at least 18 years of age, and to have the legal capacity or parental authorization to place an order on the Site. When registering their personal data during the ordering process or in the “My Account” section, the Customer must ensure the accuracy and completeness of the mandatory data they provide. In the event of an error in the recipient's contact information, RETROTAPE cannot be held responsible for the inability to deliver the Product to the Customer. RETROTAPE reserves the right to cancel any order when the Customer's IP address is located in a country different from the billing and/or delivery address.

03. Products
The Products offered for sale are those described on the Site. RETROTAPE We take the utmost care in presenting and describing these Products to best inform the Customer. However, it is possible that minor errors may appear on the Site, which the Customer acknowledges and accepts. In any event, if the delivered product is found to be non-compliant with its description on the Site, the Customer may either exercise their right of withdrawal or invoke the manufacturer's guarantee of conformity. RETROTAPE which will proceed, where appropriate, either to exchange or to refund the price (in whole or in part) possibly charged. 

The colors generated on the Site may vary slightly depending on how the Client's monitor is calibrated. RETROTAPE makes every effort to ensure that all images correspond as closely as possible to the colors of the actual Product that the Customer is purchasing, but cannot guarantee a perfect match due to incalculable factors of variation related to different possible computer configurations.

 

04. Orders
Placing an order on the Site is subject to compliance with the procedure established by RETROTAPEThis process is completed through a series of steps that the Customer must follow to validate their order. Before finalizing their order, the Customer has the opportunity to review its details and total price, and to correct any errors, before confirming it to express their acceptance. Any order confirmed by the Customer constitutes a sales contract and acceptance of all the provisions herein. 

RETROTAPE may refuse any order from a Customer with whom there is a dispute or incident relating to payment for a previous order, or who violates the provisions herein. In this case, RETROTAPE will inform the Client by email. If the Client fails to contact RETROTAPE to the correction of erroneous elements or elements contrary to these General Terms and Conditions of Sale, RETROTAPE reserves the right not to process the order. 

For every purchase made on the Site, a confirmation email summarizing the order (products ordered, price, size, quantity) is sent to the Customer by RETROTAPETo this end, the Client formally accepts the use of email for confirmation by RETROTAPE of the contents of his order.

 

05. Price and payment terms
The prices of the Products sold on the Site are shown in euros, inclusive of all taxes, but excluding shipping costs. The total price of the order (including all taxes and shipping costs) is shown in the shopping cart before payment. RETROTAPE reserves the right to change prices at any time, but Products will be billed based on the rates in effect at the time the order is registered, subject to availability. 

Products are payable in full on the day the order is placed. Payment for purchases is made by credit card (VISA®, MasterCard® and American Express®) or Apple Pay™. In all cases, payment data is neither used, exchanged, nor stored by RETROTAPEThe data recorded by payment systems (PayPal™) also constitutes proof of financial transactions carried out. 

 

06. Delivery
Products ordered on the Site are shipped directly by RETROTAPEThe customer can choose their preferred carrier and ship via parcel or tracked letter. Once the product has been shipped, the tracking number will be available in their personal "My Account" area. The customer will also be notified by email when the tracking number for their order is available. 

Delivery is made to the delivery address indicated by the Customer, which must be the Customer's residence or that of any other individual or legal entity of their choosing. Delivery cannot be made to hotels or post office boxes. To ensure timely delivery, the Customer must provide accurate and complete delivery address information (including, but not limited to: street number, building number, floor, access codes, names and/or intercom numbers, etc.).

The delivery times indicated on the Site are provided for informational purposes only, and correspond to the average processing and delivery times commonly observed. RETROTAPE cannot be held responsible for consequences due to a delivery delay that is not its fault. In the event of a damaged package (already opened, missing product, damaged product, etc.), the Customer agrees to notify the carrier and to RETROTAPEby any means, any reservations within 3 days of receiving the Product.

 

7. Right of withdrawal
The Customer has a right of withdrawal, which he may exercise without giving any reason, within fourteen (14) clear days from the delivery of the order, which will be exercised by returning - by tracked mail and at his own expense - the new Product (in its original packaging, unworn, unwashed, undamaged, unused) accompanied by the order number, according to the return procedures referred to in the following article. 

 

8. Return Procedures
Products must be returned by tracked mail, accompanied by the duly completed Return Form, according to the return procedure.

In all cases, the Customer must return the new Product (in its original packaging, unworn, unwashed, undamaged, unused), accompanied by the corresponding order number, via tracked mail.  

Upon receipt of the Product, and provided that the aforementioned return conditions are met, RETROTAPE will reimburse the Customer for any sums already paid, less any shipping costs, under the conditions set out in the following article. The Customer is advised that they must retain proof of postage. This proof of posting may be requested by RETROTAPE, in the event that a dispute arises following a failure to receive the return by RETROTAPE. 

 

9. Reimbursement
Refunds for Products under the circumstances outlined in Articles 3 (Products) and 7 (Right of Withdrawal) will be processed by RETROTAPE within a maximum of 14 business days after receipt of the Products. The refund will be issued using the same payment method chosen by the Customer at the time of their order or by issuing a voucher. Except in the case of a quality or conformity defect, return shipping costs remain the responsibility of the Customer.

11. Force majeure
The responsibility of RETROTAPE will not be enforceable if the non-performance or delay in performance of any of its obligations described in these General Terms and Conditions of Sale arises from a case of force majeure. For these purposes, force majeure is understood to mean any external, unforeseeable and irresistible event within the meaning of Article 1148 of the French Civil Code. 

 

12. Data retention and evidence agreement 
In compliance with article LArticle 134-2 of the French Consumer Code, RETROPOPE ensures the preservation of documents relating to the order placed by the Client, who may request access to them at any time. This includes messages received electronically, and more generally all electronic documents exchanged between RETROTAPE and the Client, will have the same value as that accorded to the originals. The latter will retain the electronic documents in such a way that they can constitute faithful and durable copies within the meaning of Article 1348 of the French Civil Code.

 

13. Disputes and applicable law
Placing an order online constitutes full and unreserved acceptance of these terms and conditions. Therefore, any order automatically implies the Customer's agreement to these General Terms and Conditions of Sale. These General Terms and Conditions of Sale are governed by French law.  

In case of difficulty or complaint regarding an order, the Customer is invited to contact RETROTAPE to try to find an amicable solution. In the event that no amicable agreement could be found, French law shall be the only law applicable to this contract, to the exclusion, on the one hand, of the conflict rules provided for by French law, and on the other hand, of the provisions of French law which would be contrary to these conditions.  

Any dispute relating to the interpretation, performance and termination of these terms and conditions shall be submitted to the courts of the jurisdiction where the company's registered office is located. RETROTAPE.
